1. Acceptance of terms

By downloading, installing, or using the TraceTales iOS/iPadOS application ("the App"), or by accessing this website at tracetales.co.uk ("the Website"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App or Website.

These Terms form a legally binding agreement between you and TraceTales. Please read them carefully.

2. The TraceTales service

TraceTales is an educational application designed for children aged 3–11, operated by parents or carers. It provides curriculum-aligned learning activities across English, Maths, Science, and Citizenship, along with a Parent Dashboard for monitoring progress.

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with reasonable notice where possible.

3. Eligibility and accounts

• You must be at least 18 years old and the parent or legal guardian of the child using TraceTales to create an account.
• You are responsible for keeping your account credentials confidential.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information when creating your account.
• Each account may be used for one household. Sharing account credentials outside your household is not permitted.

4. Children and parental responsibility

TraceTales is used by children under the direct supervision and responsibility of their parent or legal guardian. By creating a child profile and allowing your child to use the App, you:

• confirm that you are the parent or legal guardian of the child;
• take full responsibility for the child's use of the App;
• agree that the App is used in accordance with these Terms;
• understand that reading recordings made by your child are stored on your device and that you control their creation, playback, and deletion.

The Parent Dashboard and all account settings are protected by a PIN that only you should know. Do not share your PIN with your child.

5. Acceptable use

You agree not to:

• use the App or Website for any unlawful purpose;
• attempt to reverse engineer, decompile, or extract the source code of the App;
• interfere with or disrupt the operation of the App, Website, or associated servers;
• attempt to gain unauthorised access to any part of the service;
• use the service for commercial purposes without our written permission;
• upload or transmit any harmful, offensive, or illegal content;
• use the service in any way that could harm a child.

6. Subscriptions and payments

6.1 Free tier

TraceTales is available free of charge with a limited set of features as described on our pricing page.

6.2 Premium subscription

• Premium features are available through an auto-renewing in-app subscription managed entirely by Apple through the App Store.
• Subscription fees are charged to your Apple ID at the time of purchase and at the start of each renewal period.
• You can cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.
• We do not process payments directly and do not store your payment details.
• Refunds are subject to Apple's refund policy. To request a refund, visit reportaproblem.apple.com.
• Prices shown on this website are indicative and may differ from those confirmed at point of purchase in the App Store. The App Store price prevails.

6.3 Free trials

We may offer free trials from time to time. Unless cancelled before the trial ends, the subscription will convert to a paid subscription at the standard rate.

7. Intellectual property

All content in the TraceTales App and Website — including but not limited to text, graphics, logos, character designs, audio content, and software code — is owned by or licensed to TraceTales and is protected by UK and international copyright law.

You are granted a limited, non-exclusive, non-transferable licence to use the App for its intended personal, non-commercial educational purpose. You may not reproduce, distribute, or create derivative works from any part of the service without our prior written consent.

8. Disclaimers

TraceTales is provided on an "as is" and "as available" basis. To the fullest extent permitted by law:

• We do not warrant that the App will be error-free, uninterrupted, or free from viruses or other harmful components.
• We do not guarantee that the App will be available at all times.
• Educational content is provided for general learning purposes and is not a substitute for professional educational assessment or support.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under UK law, including rights under the Consumer Rights Act 2015.

9. Limitation of liability

To the maximum extent permitted by applicable law, TraceTales will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or loss of goodwill, arising out of or in connection with your use of the service.

Our total liability to you for any claim arising from these Terms or the service shall not exceed the total amount you have paid us in the 12 months preceding the claim.

10. Third-party services

The App is distributed through the Apple App Store. Your use of the App Store is subject to Apple's own Terms and Conditions. TraceTales is not responsible for Apple's conduct or policies.

This Website uses Google Fonts, loaded from Google's servers. Your use of Google Fonts is subject to Google's Terms of Service.

11. Termination

We may suspend or terminate your account and access to the service if you breach these Terms, with or without notice depending on the severity of the breach.

You may delete your account at any time through the App settings or by emailing hello@tracetales.co.uk. Upon deletion, your data will be permanently removed within 30 days.

12. Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to your rights as a consumer under applicable local law.

13. Changes to these terms

We may update these Terms from time to time. We will notify you of significant changes by updating the "Last updated" date and, where appropriate, by email. Your continued use of the service after changes take effect constitutes your acceptance of the revised Terms.
